The Zoning Board of Appeals granted a variance for a two-story rebuild on a flood-prone coastal property.
Zoning Board of Appeals · Meeting of July 2, 2026
EASTHAM — The Zoning Board of Appeals granted a variance for a two-story rebuild on a flood-prone coastal property. Marc and Katherine Sieger won board approval to construct a 36.1-foot dwelling at 165 Harmes Way, exceeding the standard 30-foot height limit, after the board found site-specific hardship stemming from FEMA flood-zone elevation requirements that consumed much of the allowable height on their narrow peninsula property. The board noted prior height variances for similar rebuilds at nearby Harmes Way addresses and found visual impact mitigated by distance and conservation land.
Five parties testified in favor with zero opposition; the board voted 4-1 to grant the variance, with member Douglas Byrd opposing, and unanimously adopted ten conditions including permit requirements, drainage verification, vegetation maintenance, and Registry filing.
