Eastham Conservation Commission Clears Phase One Wastewater Project With Conditions

EASTHAM — April 28, 2026 — Eastham Conservation Commission unanimously clears Phase One municipal wastewater order of conditions at busy April 28 meeting. The commission voted 6-0 to approve the order for a system covering approximately 16 miles of gravity and pressure sewer mains, four pump stations, and individual parcel connections running from 2475 to 5270 State Highway in the Nauset Estuary watershed; project representative Jackie Tupper had helped refine the 12 special conditions, two of which — a notification-of-emergencies requirement and a mandatory emergency response plan — were added since the previous hearing. The commission also approved a sand nourishment reduction at 31 Bayberry Lane from 51 to 26 cubic yards annually, backed by erosion data showing statistically insignificant long-term shoreline change, with a three-year monitoring report required before a certificate of compliance can issue. A notice of intent for David Silverman and Anna Davis at 11 Bay Lane was approved with herbicide-protocol documentation required by week's end, and a notice of intent for David Milikin at 95 Wind Jammer Lane was approved with a 3-to-1 cedar replacement condition. A separate administrative review for removal of five healthy pine trees at 165 Ginger Plum Lane was continued to May 26 after commissioners who visited the site found the trees structurally sound and leaning away from the home, directing the owner to obtain a written arborist assessment before the commission will consider approval.
